The provider is Jan Kerber, c/o IP-Management #8388, Ludwig-Erhard-Str. 18, 20459 Hamburg (hereinafter "Provider"). These Terms and Conditions apply to all contracts regarding digital products, software, subscriptions, and development services of the BuildBioz project between the Provider and the customer. Deviating conditions of the customer will not be recognized.
The Provider specifically offers the BuildBioz service for creating personalized bio-link pages, as well as Discord bots, server security modules, and individual software development. The specific scope of services is determined by the respective product description on BuildBioz.
The contract is concluded upon the customer's order on BuildBioz and acceptance by the Provider. All prices are final. Due to the small business status according to § 19 UStG (German VAT Act), no VAT is shown. Payments are due immediately. Subscriptions are billed in advance for the respective billing period.
Subscriptions on BuildBioz have the respectively agreed term. They are paid for in advance. Cancellation can be made by the customer at any time via the customer panel and takes effect at the end of the booked term. The Provider reserves the right to terminate the contract without notice for good cause.
All rights to the source code of BuildBioz remain with the Provider. The customer receives a simple, non-transferable right of use for the duration of the contract. Any distribution, modification, or resale of the underlying software is prohibited.
The Provider is only liable in cases of intent and gross negligence. In cases of simple negligence, the Provider is only liable for the breach of essential contractual obligations. Liability is limited to the typical, foreseeable damage. Liability for lost profits or loss of data is excluded.
German law shall apply exclusively. The place of jurisdiction is Paderborn, Germany, as far as legally permissible.
